Terms of Use

These Terms of Use govern your access to and use of the marketing website at qarmiq.ai (the "Site"). They are separate from the terms that apply to the Qarmiq product, and they set out the rights and obligations of all users regarding the use of the Site.

Looking for the customer agreement? If you have purchased a Qarmiq subscription, your use of the product is governed by our SaaS Subscription Agreement, the relevant Order Form, our Acceptable Use Policy, and (where applicable) our Data Processing Agreement.

Acceptance of these terms

By accessing or using the Site, you agree to these Terms of Use. If you do not agree to these terms, please discontinue your use of the Site immediately. These terms constitute a legally binding agreement between you and Qarmiq, Inc., a corporation incorporated in the State of Delaware, United States ("Qarmiq", "we", "us", “our”).

Your access to and use of the Site is conditioned on your acceptance of and compliance with these Terms of Use. These Terms of Use apply to all visitors, users and others who access or use the Site.

Your access to and use of the Site is also conditioned on your acceptance of and compliance with the Privacy Policy of Qarmiq. Qarmiq’s Privacy Policy describes its policies and procedures on the collection, use and disclosure of your personal information when you use the Site and tells you about your privacy rights and how the law protects you. Creation of Account

You may be required to create an account and specify a password in order to avail and use certain services or features on the Site. You must be of 18 years, in order to create an account and must provide true and accurate information about yourself. You will not impersonate anyone else to create an account.

Use of the Site

The Site is provided for general informational purposes about Qarmiq and its products. You agree to use the Site only for lawful purposes and in a way that does not infringe the rights of, restrict, or inhibit anyone else's use of the Site, is offensive or interferes with any feature employed on the Site.

You must not:

(i) Use the Site in any way that would breach or violate any applicable laws or regulations.

(ii) Attempt to gain unauthorized access to the Site, the servers on which it is hosted, or any connected systems.

(iii) Use any automated means, including but not limited to scraping, bots, or crawlers, to access the Site in a way that imposes an unreasonable load on our infrastructure.

(iv) Reproduce, duplicate, copy, sell, or otherwise exploit any portion of the Site for commercial purposes without our prior written consent.

(v) Introduce or transmit any virus, malware, ransomware, or any other malicious code or material that may interfere with the operation, security, or integrity of the Site or any connected systems.

(vi) Attempt to circumvent or interfere with any security features, authentication mechanisms, or technical measures implemented to protect the Site or its content.

(vii) Use the Site to transmit, distribute, or facilitate the sending of unsolicited or unauthorized communications, including spam, chain letters, or other similar communications.

(viii) Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of any software, functionality, or technology made available through the Site.

(ix) Probe, scan, test the vulnerability of, or otherwise interfere with the security, integrity, or proper functioning of the Site or any networks, systems, or services connected to the Site.

We reserve the right to restrict, suspend, or terminate your access to the Site at any time if we reasonably believe or are required under applicable laws or on receipt of notice from relevant authority on the ground that you have breached these Terms or that your use of the Site poses a security, legal, or operational risk to us or any third party.

Intellectual property

All content on the Site, including text, graphics, logos, images, audio, video, downloads, and software, is the property of Qarmiq, Inc. or its licensors and is protected by applicable intellectual property laws. The "Qarmiq" name and logo are trademarks of Qarmiq, Inc.

You may view, download, and print pages from the Site for your own personal or internal business use, subject to the restrictions in these terms. Except for the limited right to access and use the Site in accordance with these Terms, you do not possess any right, title or interest on the contents of the Site. Any other use requires our prior written consent.

Nothing in these Terms grants you any license or other right to use Qarmiq's trademarks, trade names, logos, branding, domain names, or other proprietary identifiers except with our prior written consent.

User submissions

If you submit information to us through the Site (for example, via a contact form, newsletter sign-up, or trial request), you confirm that the information is accurate and that you have the right to submit it. Information you submit is handled in accordance with our Privacy Policy.

You represent and warrant that your submissions do not infringe the intellectual property or other proprietary rights of any third party, do not contain unlawful, defamatory, obscene, or malicious material, and fully comply with all applicable laws.

Qarmiq implements reasonable and appropriate technical and organizational security safeguards to protect all personal data in its possession or under its control against unauthorized processing or personal data breaches, including the Digital Personal Data Protection (DPDP) Act, 2023 as applicable in India.

The Site may contain links to third-party websites or services (for example, our documentation site, our LinkedIn page, or partner sites). These links are provided solely for your convenience. We do not monitor or endorse the content of third-party sites and are not responsible for their availability, content, accuracy or data privacy practices. These Terms of Use are governed by the laws of Victoria, Australia. Any dispute arising out of or in connection with these terms or your use of the Site shall be subject to the exclusive jurisdiction of the courts of Victoria, Australia.

Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable, that provision shall be deemed severed to the extent necessary, and the remaining provisions shall remain in full force and effect.

Waiver

No failure or delay by Qarmiq in exercising any right or remedy under these Terms shall constitute a waiver of that right or remedy, nor shall any single or partial exercise preclude any further exercise of that or any other right or remedy.

Electronic Communications

By communicating with us electronically or using the Site, you consent to receive communications from us electronically, including notices relating to these Terms, where permitted by applicable law.
